Chapter 7

A Chapter 7 bankruptcy is the most commonly filed type of bankruptcy across the country.
A Chapter 7 bankruptcy allows you to wipe out most unsecured, non-priority debts.
Those are debts like credit cards, medical bills, unsecured personal loans, overdraft fees, old utilities, old cell phone bills, old apartment rent, repossessions, old foreclosures and more.
If you are current on your house and cars and don't have too much equity in your property you can keep your assets as well.
Most of our Chapter 7 clients keep all of their property and are able to wipe out all of their unsecured debts.
Chapter 13

The Means Test is basically a calculation of your household income over the past six months compared to the median for the state where you live.
If the household income for the past six months exceeds the median, your disposable income will be reviewed.
If a debtor exceeds the median income, the Chapter 13 plan will be paid over a 5 year or 60 month period.
The Chapter 13 bankruptcy plan will include the amount you are behind on your home, your monthly house payments to your mortgage company, your auto loans, taxes and a percentage of unsecured debts including credit cards, personal loans, medical bills, old repossessions and old foreclosures.

Generally, a Chapter 7 bankruptcy is a liquidation bankruptcy or a legal way to wipe out your debts and start fresh.
You will be able to wipe out most of your unsecured debts, such as credit cards, personal loans, repossessions, medical bills, etc.
Most people who file Chapter 7 bankruptcy are able to keep their homes and cars as long as they are current on their payments.
