Attorney Fees and Costs

Pursuant to Family Code Section 2030, the Court may make an order for the party earning a higher income to pay a portion of the other party's attorney fees and/or costs.
Additionally, the Court may order that either or both parties access a community account to assist in their payment of attorney fees and costs.
Many times, attorney fees are ordered to be paid on a monthly basis until paid in full, unless there are assets available, or a party has sufficient income to pay the amount ordered at one time.

Division of Property

California is a community property state whereby the division of property is to be fairly and equally divided.
In the event of an unequal division of community property, one party will most of the time owe an equalization payment to the other party, in order to equalize the division of property.
Except as otherwise provided by statute, all property, real or personal, wherever situated, acquired by a married person during the marriage while domiciled in this state is community property.
If a party is making a claim of separate property, whether it be a claim in real property or a financial account, that separate interest may require a tracing to make such determination.

If a party is self-employed, it is necessary to have a cash flow analysis prepared of their income in order to determine their proper income for the purpose of making a proper support order.
Just some of the factors that play into determining income are any perks that are paid on behalf of the self-employed spouse, i.e., cell phones, vehicle expenses, insurance, monies paid into a retirement plan, and also depreciation.
It is also necessary when there is a business in a dissolution or legal separation action for the business to be valued to determine the community and/or separate property interest.
